Dissolution of Muslim Marriage (Divorce & Khula)
A Muslim marriage can dissolve in two ways:
1️⃣ Divorce (Talaq) by Husband
The husband issues a written divorce declaration and must legally notify the Union Council in writing.
Failure to notify can create legal complications.
2️⃣ Khula by Wife
If the wife does not have the delegated right of divorce (Talaq-e-Tafweez), she may file a Khula case in the Family Court under the:
-
Dissolution of Muslim Marriages Act 1939
-
Muslim Family Law Ordinance 1961
-
Family Courts Act 1964
M.A Law Associate helps women file Khula cases and obtain the Khula Decree & NADRA Khula Certificate.
Legal Process of Divorce (Talaq) by Husband
According to the Muslim Family Laws Ordinance 1961:
-
Husband declares Talaq (verbally or in writing).
-
Notice must be sent to the Chairman Union Council.
-
A copy of the notice must be sent to the wife.
-
Arbitration Council starts reconciliation meetings.
-
After 90 days, if reconciliation fails, the divorce becomes final.
-
Union Council issues the NADRA Divorce Certificate.
If the wife is pregnant, the divorce becomes final after the pregnancy ends.

Talaq-e-Tafweez (Delegated Divorce)
In Islam, a husband can delegate his right of divorce to his wife, allowing her to file divorce independently—this is called Talaq-e-Tafweez.
It is legally recognized under:
✔ MFLO 1961 (Sections 7 & 8)
✔ 2013 CLC 1625
We help review Nikah Nama clauses and guide clients on delegated divorce rights.
Failure to Give Notice of Talaq
If a husband does not notify the Union Council:
❌ Divorce is not legally valid
❌ It may lead to criminal allegations (e.g., Zina accusations under old laws)
❌ Wife may claim past maintenance
